These Terms of Service (“Terms”) govern your access to and use of www.stephenbabcock.com (the “Website”) and your interaction with official social-media accounts, channels, videos, livestreams, posts, descriptions, comments, responses, and other online content controlled, sponsored, or authorized by Babcock Partners, LLC d/b/a Babcock Injury Lawyers (collectively, the “Firm Online Services”).
References to “Babcock Injury Lawyers,” the “Firm,” “we,” “us,” or “our” mean Babcock Partners, LLC d/b/a Babcock Injury Lawyers.
These Terms govern your relationship with the Firm concerning the Firm Online Services. They do not govern the operation of YouTube, Google, or another third-party platform. Your use of a third-party platform is also subject to that platform’s own terms, privacy policy, and other rules.
By accessing or using the Firm Online Services where these Terms are posted or linked, you agree to these Terms. If you do not agree, do not use the Website or the Firm-controlled interactive features of the Firm Online Services.
Please also review our Privacy Policy and Website & Social Media Disclaimer.
1) Acceptance, Eligibility, and Scope
By accessing or using the Firm Online Services, you acknowledge that you have read, understood, and agreed to these Terms.
If you are at least 18 years old, you represent that you have the legal capacity to agree to these Terms. If you are under 18, you may use the Firm Online Services only with the involvement and permission of a parent or legal guardian. A minor should not submit an intake request or other personal information without the assistance of a parent or legal guardian.
If you use the Firm Online Services on behalf of a business or other entity, you represent that you have authority to act on behalf of and bind that entity.
These Terms apply only to your use of and interaction with the Firm Online Services. They are not a contract for legal representation and do not govern any attorney-client relationship. If you become a client, your written engagement agreement and applicable professional rules will govern the attorney-client relationship.
2) Informational Purposes Only
The Firm Online Services provide general information about Babcock Injury Lawyers and legal topics. This content is provided for informational and educational purposes only and may constitute attorney advertising.
The content is not legal advice and should not be relied upon as advice concerning a specific accident, claim, lawsuit, deadline, or other legal matter. Laws and procedures change, and legal outcomes depend on the particular facts and circumstances of each matter.
Videos and other content generally speak as of the date they were recorded or published. We do not undertake to revise or remove every older video or post when the law changes.
For additional notices, please review our Website & Social Media Disclaimer.
3) No Attorney-Client Relationship
Visiting the Website, watching a video, subscribing to or following an account, liking or sharing content, posting a comment, sending a social-media message, submitting a form, starting a chat, sending an email, or leaving a voicemail does not create an attorney-client relationship between you and the Firm.
An attorney-client relationship is created only after:
- The Firm has evaluated the matter and completed any necessary conflict review; and
- You and the Firm have entered into a signed written engagement agreement.
Do not assume that the Firm represents you or is taking action to protect your rights unless you have received written confirmation of representation.
Information sent before an attorney-client relationship is formed may not be protected by the attorney-client privilege. The Firm will handle inquiries in accordance with applicable professional obligations, but you should provide only the basic information necessary to request contact until representation is confirmed.
4) Time-Sensitive Matters and Emergencies
The Firm Online Services are not intended for emergency use. If you have an emergency, call 911 or the appropriate emergency service.
Legal matters may involve strict deadlines, including statutes of limitation, prescriptive periods, appeal deadlines, and notice requirements. Do not assume that the Firm knows about or is protecting a deadline because you submitted a form, posted a comment, sent a direct message, sent an email, or left a voicemail.
Social-media platforms may delay, filter, hide, or fail to deliver messages. Do not use a public comment or social-media message for a time-sensitive matter. If your situation is time-sensitive, call the Firm directly.
5) Communications, Calls, Texts, and Messaging
5.1 Contact Methods
The Firm Online Services may allow you to contact us through a web form, telephone, email, chat, text message, social-media platform, or another communication service. The availability of any contact method may change without notice.
5.2 Responses to Your Inquiry
By asking us to contact you and providing a telephone number, email address, or other contact information, you authorize the Firm and service providers acting on its behalf to contact you for purposes related to your inquiry, including responding to your request, obtaining preliminary information, performing a conflict review, or scheduling a consultation.
You represent that the contact information you provide belongs to you or that you are authorized to provide and use it. You agree to promptly notify us if your contact information changes or if we have reached the wrong person.
5.3 Marketing Communications
Marketing communications are optional. We will send marketing calls, texts, or emails only when you have consented or when otherwise permitted by law.
Consent to receive marketing communications is not a condition of requesting a consultation, hiring the Firm, or receiving legal services.
You may unsubscribe from marketing emails through the unsubscribe link included in the message. You may opt out of marketing text messages by replying STOP or following the instructions provided in the message. Message and data rates may apply, and message frequency may vary.
5.4 Automated Technology
If applicable law requires separate or additional consent before automated technology may be used for a particular communication, that consent will be requested separately. These Terms do not independently authorize communications for which applicable law requires a separate written consent.
5.5 Call Monitoring and Recording
Calls may be monitored or recorded for quality assurance, training, security, or documentation purposes where permitted by law. When notice or consent is required, it will be provided or requested. If you do not want a call recorded, notify us at the beginning of the call.
5.6 Social-Media Communications
Social-media messages and comments may be processed, stored, monitored, or disclosed by the platform provider. They may not be private or secure. Do not use social media to send confidential, sensitive, or time-sensitive information.
A response, reaction, “like,” “heart,” or other interaction by the Firm does not constitute legal advice or create an attorney-client relationship.
6) Privacy
Your use of the Firm Online Services is subject to our Privacy Policy, which explains how we collect, use, disclose, and safeguard information.
If these Terms conflict with the Privacy Policy concerning the Firm’s handling of personal information, the Privacy Policy will control.
YouTube, Google, and other third-party platforms may independently collect and process information under their own privacy policies. We do not control their independent data practices.
7) User Submissions, Comments, and Intake Information
7.1 Information You Submit
If you submit information through a Firm Online Service, you represent that the information is accurate to the best of your knowledge and that you have the right and authority to provide it.
Do not submit another person’s confidential, medical, financial, or identifying information unless you are authorized to do so.
7.2 No Obligation to Accept Representation
Submitting information does not obligate the Firm to evaluate the matter, provide legal advice, respond within a particular time, or accept representation.
The Firm may decline a matter for any lawful reason and is not required to explain its decision.
7.3 Use of Intake Information
We may use information submitted through an intake form, email, telephone call, chat, or private message to evaluate your inquiry, perform conflict checks, respond to you, and operate our intake process, consistent with our Privacy Policy and applicable professional obligations.
7.4 Public Comments and Other Public Submissions
Comments posted publicly on YouTube or another platform may be visible to the Firm, the platform, other users, search engines, and the general public. Do not include confidential, sensitive, medical, financial, case-specific, or time-sensitive information in a public comment.
You remain responsible for content you post. Content posted through a third-party platform is also governed by that platform’s terms and policies.
The Firm does not claim ownership of a third party’s content merely because it appears near our content. We may, however, use the platform’s built-in functions to respond to, share, embed, report, hide, or moderate content as permitted by the platform’s rules.
8) Acceptable Use
You agree not to use the Firm Online Services or Firm-controlled interactive features to:
- Engage in unlawful, harmful, fraudulent, deceptive, or abusive conduct;
- Submit information that you know is false, misleading, or materially incomplete;
- Impersonate another person or misrepresent your identity, affiliation, or authority;
- Threaten, harass, intimidate, stalk, defame, or unlawfully disclose personal information about another person;
- Post spam, unauthorized advertising, malicious links, or repetitive or irrelevant content;
- Upload or transmit malware, viruses, malicious code, or other harmful material;
- Attempt to gain unauthorized access to the Website, accounts, servers, databases, or related systems;
- Interfere with, disrupt, overload, damage, or circumvent the operation or security of the Firm Online Services;
- Collect or harvest personal information about other users without authorization;
- Infringe or violate another person’s intellectual-property, privacy, publicity, contractual, or other legal rights;
- Systematically scrape, copy, harvest, or extract Firm content or data through automated means, including for training artificial-intelligence or machine-learning systems, except as authorized in writing or permitted by applicable law;
- Remove or alter copyright, trademark, attribution, or other proprietary notices; or
- Use Firm content in a manner that falsely suggests sponsorship, endorsement, affiliation, or an attorney-client relationship.
9) Comment Moderation and Access Restrictions
We may, but are not obligated to, monitor comments, submissions, or interactions involving Firm-controlled accounts or features.
We may remove, hide, restrict, report, or decline to respond to content that we believe violates these Terms, applicable platform rules, or applicable law, or that is harmful, misleading, abusive, irrelevant, or inappropriate.
We may block or restrict a user’s access to Firm-controlled accounts or interactive features when reasonably necessary to protect the Firm, its clients, other users, or third parties.
Our decision not to remove or respond to content does not mean that we verify, adopt, sponsor, or endorse it.
10) Intellectual Property and Limited License
The Website and Firm-created content—including text, videos, audio, graphics, photographs, designs, logos, slogans, publications, downloads, and other materials—are owned by or licensed to the Firm and are protected by copyright, trademark, and other intellectual-property laws.
Subject to these Terms, the Firm grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and view Firm content for your personal, non-commercial, informational use.
You may use platform-provided sharing, linking, and embedding functions in accordance with the platform’s terms, provided you do not alter the content or falsely suggest that the Firm sponsors, endorses, or is affiliated with you or your use.
Except as permitted by these Terms, applicable platform functionality, applicable law, or written permission from the Firm, you may not reproduce, republish, distribute, sell, license, publicly display, modify, create derivative works from, or commercially exploit Firm content.
Nothing in these Terms grants a license to use the Firm’s name, logos, slogans, trademarks, or service marks. Rights expressly granted by applicable law, including lawful fair use, are not restricted by these Terms.
11) Third-Party Platforms, Links, and Services
The Firm Online Services may include links to or content hosted by YouTube, Google, social-media platforms, maps, messaging providers, news organizations, government agencies, medical sources, or other third parties.
Third-party platforms and services are independently operated. We do not control and are not responsible for their availability, functionality, security, content, terms, recommendations, advertising, or privacy practices.
YouTube and other platforms may display advertisements, suggested videos, comments, links, or other material before, during, after, or alongside Firm content. Unless expressly stated by the Firm, such material is selected or supplied by the platform or another third party and does not indicate the Firm’s sponsorship, approval, affiliation, or endorsement.
Your use of a third-party platform or service is at your own risk and is governed by that third party’s terms and policies. If these Terms conflict with a platform’s terms regarding your use of that platform, the platform’s terms govern your relationship with the platform, while these Terms govern your relationship with the Firm.
12) Availability, Modifications, and Termination
We may add, modify, suspend, restrict, or discontinue any part of the Firm Online Services at any time without notice.
We do not guarantee that any Website feature, video, post, comment, link, download, or other content will remain available. Content may be edited, archived, made private, or removed.
We may restrict or terminate access to Firm-controlled features or accounts when we reasonably believe a user has violated these Terms or when necessary to protect security, legal rights, clients, users, or third parties.
13) Disclaimers of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FIRM ONLINE SERVICES AND FIRM CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, AND RESULTS.
We do not warrant that the Website or other Firm Online Services will be uninterrupted, error-free, secure, current, or free from viruses or other harmful components. You are responsible for implementing safeguards appropriate to your devices and use.
We do not warrant or endorse third-party platforms, links, advertisements, comments, products, services, or content.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FIRM AND ITS LAWYERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE FIRM ONLINE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FIRM’S TOTAL LIABILITY FOR A CLAIM ARISING SOLELY OUT OF OR RELATED TO THE FIRM ONLINE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS (US $100).
These limitations apply even if the Firm has been advised of the possibility of such damages. Some jurisdictions do not allow certain exclusions or limitations, so some limitations may not apply to you.
Nothing in these Terms limits liability that cannot lawfully be excluded or limited. These limitations do not govern legal services provided under a written engagement agreement or duties arising from an established attorney-client relationship.
15) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the Firm and its lawyers, employees, and agents from claims, liabilities, damages, judgments, and reasonable expenses arising from your unlawful misuse of the Firm Online Services, your material violation of these Terms, or your infringement or violation of another person’s legal rights.
This provision does not require you to indemnify the Firm for the Firm’s own unlawful conduct or for liability that cannot lawfully be shifted to you.
16) Governing Law and Venue
These Terms and disputes between you and the Firm arising from the Firm Online Services are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.
To the extent permitted by law, any lawsuit arising out of or relating to these Terms or the Firm Online Services must be brought in a state court of competent jurisdiction located in East Baton Rouge Parish, Louisiana, or in the United States District Court for the Middle District of Louisiana if federal subject-matter jurisdiction exists. You consent to personal jurisdiction and venue in those courts.
This section does not override a law that gives you a non-waivable right to bring a claim in another jurisdiction or venue.
17) Severability, Waiver, and Entire Agreement
If a provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
A failure by the Firm to enforce a provision of these Terms is not a waiver of that provision or any other right.
These Terms, together with the Privacy Policy and Website & Social Media Disclaimer, constitute the agreement between you and the Firm concerning use of the Firm Online Services. They do not replace or modify a written engagement agreement for legal services.
If you become a client and a written engagement agreement conflicts with these Terms concerning legal representation, the engagement agreement controls.
18) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date indicates when these Terms were most recently revised.
Revised Terms become effective when posted unless a later effective date is stated or applicable law requires additional notice. Your continued use of the Firm Online Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
A revision will not retroactively modify a written engagement agreement or established attorney-client relationship.

20) Attorney Advertising, Past Results, Fees, and Costs
The Firm Online Services may constitute attorney advertising. Stephen Babcock, Louisiana Bar No. 26792, is the lawyer responsible for this content.
Any references to results, settlements, verdicts, arbitration awards, recoveries, or case outcomes are intended to provide information about the Firm’s experience.
Results may vary. Past results do not guarantee a similar outcome or future success. Results depend on the facts, law, evidence, damages, insurance coverage, parties, attorneys, judges, juries, and procedural circumstances of each matter.
Any discussion of a “free consultation,” “free case review,” “no fee unless we recover,” or similar statement is general information and is not an offer or contract for legal services.
Attorney’s fees and litigation costs and expenses are different. For cases the Firm accepts on contingency, you owe no attorney fees or case costs unless there is a recovery. If there is a recovery, case costs may be owed in addition to attorney fees, as provided in the written engagement agreement. The fee and cost terms are explained in writing before representation begins.
For additional information, please review our Website & Social Media Disclaimer.
Effective for use of the Firm Online Services only. These Terms are not a contract for legal services and do not create an attorney-client relationship.
