Your Post-Accident Checklist

After a crash or other injury, start with safety and the records you can gather without putting yourself at risk.

  1. Get help and medical care. Call 911 for injuries or immediate danger. Follow responders’ instructions and tell your medical provider about your symptoms.
  2. Report what happened. Notify the appropriate police agency after a crash, or the property owner or manager after an injury on their premises. Save the report or incident number.
  3. Record the scene safely. Photograph damage, hazards, road conditions and visible injuries. Exchange driver and insurance information and get witness contact details.
  4. Protect recordings. Save original dash-cam footage and note nearby cameras, their locations and the incident time. Ask about preservation promptly.
  5. Start a claim folder. Keep medical instructions, receipts, missed-work records and insurer messages. Notify your own insurer promptly and check your policy’s reporting requirements.
  6. Check your next steps. Have the incident date, fault questions and any proposed release reviewed before settling. An insurance discussion does not stop a lawsuit deadline.

Why Should I Get Legal Help Following an Accident?

An injury can be a physically and emotionally traumatic event. Not only do you have to deal with physical injuries, but there is also the stress of dealing with the legal process. Personal injury law is a complex and nuanced area of law that can be difficult to understand. You need an experienced Louisiana personal injury lawyer with a proven track record of success fighting for you.

Following an accident, you may be entitled to compensation for your medical bills, lost wages, pain and suffering, and much more. The at-fault party’s insurance company will likely try to lowball you on your claim. An experienced lawyer handling personal injury claims will fight for the full compensation you deserve.

Our experienced injury attorneys deal with insurance companies daily. We are aware of all their tactics to try to deny, delay, and devalue your claim, and we know how to combat them effectively. We don’t need insurance companies to play for us to beat them at their games.

The recovery process after an accident can be physically and emotionally difficult. You shouldn’t have to go through it alone. Resources are available to help you get your life back on track. You can start by talking to an experienced Louisiana personal injury attorney at Babcock Injury Lawyers.

We put our clients first and work tirelessly to protect your rights and build your strongest legal strategy to recover the full compensation you deserve.

Is It Necessary for Me to Go to Trial in My Louisiana Personal Injury Case?

Some injury claims settle and others require a lawsuit or trial. The right course depends on the facts, the available evidence, insurance coverage and the positions of the parties. We can explain the options, discuss an offer with you, and prepare the case for the steps it requires. A case review does not promise a particular settlement or result.

How Much Does a Louisiana Personal Injury Lawyer Cost?

Your initial Babcock Injury Lawyers case review is free. For injury matters we accept on contingency, you owe no attorney fees or case costs unless we recover compensation. If there is a recovery, the written agreement explains the fee percentage and how expenses are handled. Before signing, ask how the fee is calculated, when costs are deducted, and whether the percentage changes at different stages of the case.

What Is the Time Limit for a Louisiana Personal Injury Lawsuit?

For many delictual injury claims arising on or after July 1, 2024, Louisiana Civil Code article 3493.1 provides two years from the day injury or damage is sustained. Earlier incidents and specialized claims can follow different rules. An insurance claim and a lawsuit are different steps; do not assume negotiations protect a filing deadline.

Fatal-injury claims require a separate check. Under the current wrongful-death and survival articles, the general period is the longer of one year from death or two years from injury or damage. Medical-malpractice wrongful death has a one-year-from-death provision; medical-malpractice survival timing is governed by La. R.S. 9:5628. The relevant dates, claim type and governing version of the law must be reviewed together.

Claims involving a government entity can have specific requirements for presenting a claim, requesting service and filing suit. The applicable deadlines depend on the defendant and the type of claim. Our Louisiana filing-deadline guide explains the distinctions. Have your actual dates checked promptly.

Can I Recover If I Was Partly at Fault?

Comparative fault assigns a share of responsibility to the people who contributed to an injury. Under Louisiana Civil Code article 2323, effective January 1, 2026, your own negligence below 51% reduces recoverable damages proportionally; negligence of 51% or more bars recovery under that rule. The incident date and applicable law matter, and the article has a separate provision for harm involving an intentional wrongdoer.

Hypothetical example: If damages are $100,000 and you are 30% negligent, the proportional reduction leaves $70,000 before attorney fees, case costs or other applicable adjustments. At 51% negligence, the current rule bars recovery. This example explains the calculation and does not estimate any particular claim’s value.

An insurer’s proposed percentage can be disputed. Scene photographs, witness accounts, video and vehicle evidence can help establish what happened. Our Louisiana comparative-fault guide explains the framework in more detail.

Protect Evidence Before It Changes

A lawsuit deadline is not a safe waiting period for evidence. Start with these steps:

  • Keep original files. Back up photographs and video with their dates and other file information. Keep an unedited original when making a copy to share.
  • Identify cameras promptly. Note the business or property, camera location and relevant time window. Recording systems have different retention periods; there is no single deadline that protects every recording.
  • Plan before repairs or disposal. Identify who has the vehicle or damaged equipment. Ask about documenting and inspecting it before its condition changes, while addressing storage costs promptly.
  • Keep a dated record. Save witness contacts, medical paperwork, missed-work records, receipts and insurer communications together.

Our evidence-preservation guide explains how to protect recordings and physical evidence.

Who Pays for a Rental Car After a Wreck?

Your own policy’s rental reimbursement coverage and a claim against the other driver’s insurer are different routes. Collision coverage alone does not establish that rental expenses are covered. Check the approved rate, payment limits and end date before committing to a rental. See our rental-car coverage explanation and receipt checklist.
