Name the responding agency when requesting report photographs; a crash on an I-49 ramp may have a State Police report, while a city street may involve Natchitoches Police. Interview witnesses about where the rider was before contact, not only how far the motorcycle traveled afterward.

For most delictual claims arising on or after July 1, 2024, Civil Code article 3493.1 provides a two-year period running from injury or damage. Claims arising earlier, claims against certain defendants, and special causes of action require a separate deadline check. Do not calculate the filing date from the date you obtained a report.
Civil Code article 2323 now bars recovery in ordinary negligence claims if the injured person is found 51% or more at fault, and reduces damages proportionally when fault is below 51%.
