Who controlled the mezzanine opening when the worker fell? The building’s design may be relevant, but so may the person who opened a loading gate, placed a pallet or assigned the work that day. A Louisiana warehouse-fall investigation needs both the fixed structure and the daily operation.
Establish when the edge was exposed
Preserve surveillance video showing the loading sequence before the fall. It may establish when a gate or barrier was opened, how long the edge remained exposed and how the worker and forklift moved through the area.
A photograph of an open gate after the rescue cannot establish its earlier position by itself. Compare the full recording with photographs of the hinges, latch, fasteners, chains and any substitute barrier. Record the floor elevation, edge location, railing, pallet position, lighting and travel path.
These details help distinguish a problem with the structure or barrier from the way the opening was being used. They also help test a later account against the conditions visible at the time.
Compare the lease with the work actually performed
A building owner may control the fixed structure while a tenant controls daily loading. Review the lease alongside maintenance records, modification plans, site safety rules and inspection reports. Prior reports of a gate being left open may identify an operating concern that would not appear in the original building plans.
29 C.F.R. §1910.28 addresses fall-protection duties in covered general-industry workplaces. The height, platform and activity determine which provisions apply. An OSHA finding does not, by itself, decide a landlord’s or unrelated contractor’s Louisiana duty or control over the opening.
For a workplace injury claim involving the mezzanine, compare the building-control and loading-operation records. What did each company control, and how does that role relate to the fall?
For a compensable employee injury, workers’ compensation exclusivity may affect a claim against the employer. Our compensation overview explains that separate benefits framework. A potential third-party claim alongside compensation involving a landlord or outside contractor still needs its own duty and conduct analysis. The lease and evidence of daily loading help identify whose role needs examination.
